Works of authorship come in all kinds; drawings, specifications, software, menus, photos, art including paintings, sculptures and modern installations, digital images, written and recorded works and their respective copies and derivative works to name a few. A “work of authorship” is defined in broad terms under the copyright laws to include almost any type of original creative expression that is captured in some perceptible form or on a machine readable media. There are several ways one may acquire a copyright.
In the first instance a copyright inures to the benefit of an author at the time of the creation of a work of authorship. Otherwise, a copyright is transferable, as with other types of property, by assignment, sale or by operation of a will or the laws of intestacy. A number of conditions must be met in order for there to be a valid transfer of copyright. Copyrights are also an appropriate subject matter for licensing.
